Dairesi\u2019nin \u00a0Esas N2018\/5709, Karar N2021\/10534 \u00a0say\u0131l\u0131 karar\u0131 ile Maslak ve \u00c7evresi 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131\u2019n\u0131n plan hiyerar\u015fisine ayk\u0131r\u0131l\u0131\u011f\u0131 y\u00f6n\u00fcnden temyiz isteminin kabul\u00fcne, \u0130stanbul B\u00f6lge \u0130dare Mahkemesi 4. \u0130dari Dava Dairesince verilen 18\/05\/2018 tarih ve E.2017\/1187, K:2018\/1104 say\u0131l\u0131 karar\u0131n Bozulmas\u0131na, yeniden karar verilmek \u00fczere dosyan\u0131n an\u0131lan B\u00f6lge \u0130dare Mahkemesi \u0130dari Dava Dairesine g\u00f6nderilmesine kesin olarak karar verildi\u011fi, \u00a0 \u00a0\u0130stanbul B\u00f6lge \u0130dare Mahkemesi \u00a04. \u0130dari Dava Dairesi taraf\u0131ndan da Esas N2021\/1660, Karar N2022\/46 say\u0131l\u0131 karar\u0131 ile Maslak ve \u00c7evresi 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131\u2019n\u0131n plan hiyerar\u015fisine ayk\u0131r\u0131l\u0131\u011f\u0131 nedeniyle istinaf talebinin kabul\u00fc ile \u0130stanbul 2. \u0130dare Mahkemesinin 06\/06\/2017 tarih ve E:2015\/2177, K:2017\/1332 say\u0131l\u0131 karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na, dava konusu i\u015flemin iptaline karar verildi\u011fi 09.02.2022 \u00a0tarihli \u00d6zel Durum A\u00e7\u0131klamas\u0131 ile bildirilmi\u015fti.\u00a0 \u00a0 \u00a0\u00a0<\/p>\n<p>S\u00f6z konusu karar temyiz edilmi\u015f olundu\u011fundan, 06.04.2023 tarihinde taraf\u0131m\u0131zca tebell\u00fc\u011f edilen Dan\u0131\u015ftay 6.
